10. COLLUSION, CHEATING AND FRAUD

If You are gaming on peer to peer events via the William Hill Websites (i.e. against third parties) You cannot see who You are gaming against and they may be (i) colluding with other third parties or (ii) using unfair external factors or influences (commonly known as cheating) or (iii) undertaking fraudulent activities to Your disadvantage and their advantage, such practices are not allowed and we will take all reasonable steps to prevent them.

If You suspect a person is cheating or colluding or undertaking a fraudulent activity it should be reported to us by emailing us on customerservices@williamhill.co.uk or calling us on 0800 085 6296.

We reserve the right to terminate these Terms of Use, withhold the balance of Your Account, suspend Your Account and recover from Your Account the amount of any affected pay-outs, bonuses or winnings if:

i) You are found or suspected to be participating in any form of collusion or fraudulent practice;

ii) we become aware that You have placed bets and/or gamed with any other online provider of gambling services and are suspected (as a result of such play) of fraud, collusion (including in relation to charge-backs) or unlawful or improper activity;

iii) we become aware that You have "charged back" or denied any of the purchases or deposits that You made to Your Account; or

iv) You become bankrupt or analogous proceedings occur anywhere in the world.

Where we suspect that You are participating in any form of collusion or fraudulent practice we reserve the right to report such activity or suspicions to the police or relevant authorities.

11. TERMINATION

You are entitled to close Your Account and terminate these Terms of Use on twenty four (24) hours' notice to us at any time by withdrawing the entire balance from Your Account and sending an email to us or phoning us on 0800 085 6296. We will respond within a reasonable time provided that You continue to assume responsibility for all activity on Your Account until such closure has been affected by us.

We are entitled to terminate these Terms of Use on written notice (or attempted notice) to You at the email address You provide to us when registering for Your Account. In the event of termination by us, we will provide notice of the termination to You by email and, other than where termination is made pursuant to paragraph 10 or paragraph 21, as soon as reasonably possible following a request by You we will refund the balance of Your Account using the same method of payment which you provided upon registration of Your Account, or such other accepted updated payment methods with which You have provided us subsequently.

Where we terminate pursuant to paragraph 10 or paragraph 21 the balance of Your Account will be non-refundable and deemed forfeited.

Termination of this Agreement other than pursuant to paragraph 10 or paragraph 21 will not affect any outstanding bets, provided that such outstanding bets are valid and not in breach of these Terms of Use in any way.

The following paragraphs shall survive any termination of these Terms of Use: 20, 21, 23, 24, 26, 29, 30, 31, 32 and 33 along with the Privacy Policy and any other paragraphs which are required for the purposes of interpretation.

12. ACCESSING AND USE OF OUR SITES

You are responsible for making all arrangements necessary for You to have access to the William Hill Websites.

Under no circumstances should any user of any William Hill Website make any submission which is reasonably likely to be considered or is defamatory, abusive, obscene, unlawful, of a racist, sexist or other discriminatory nature, or which could cause offence. You must not use any abusive or aggressive language or images, swear, threaten, harass or abuse any other person, including other users.

You must not corrupt the William Hill Websites, flood any William Hill Websites with information so as to cause any William Hill Website not to function or use any features which may affect the function of any William Hill Website in any way for example (but not limited to) viruses, worms, logic bombs or similar. Any multiple submissions or "spam" are strictly prohibited. You must not interfere or tamper with, remove or otherwise alter in any way, any information in any form which is included on any William Hill Website.

You shall use the William Hill Websites for personal entertainment only and shall not be allowed to provide access or reproduce any William Hill Website in any form whatsoever without our express consent.

13. TELEPHONE BETTING

Your Account can be used to place bets via William Hill’s Telephone Betting Services. If you place a telephone bet your contract will be with William Hill Credit Limited and will be governed by the William Hill Fair Deal Telephone Betting Rules

14. BETTING AND GAMING TERMS

Terms used in betting and gaming are numerous. A glossary explaining the meaning of the betting and gaming terms is available at theOnline Help Centre. Should You be in any doubt as to the meaning of any word or phrase You should look up its meaning in the glossary relating to the event You are betting or gaming on. If You are still in any doubt You should contact our customer services team and should not place any bet or game on any event until its meaning is understood to Your satisfaction. We cannot accept any responsibility if You place a bet or game via the products offered via the William Hill Websites in circumstances where You do not understand any of the terms involved in or relating to the bet or game.

15. ALTERATION OF THE WILLIAM HILL WEBSITES

We may, in our absolute discretion, alter or amend any product offered via the William Hill Website at any time for the purpose of ensuring the ongoing provision of the William Hill Websites and may alter prices offered via the products offered via the William Hill Websites where such alterations do not affect games and/or bets already in progress. From time to time, we may restrict You from accessing some parts of the William Hill Websites.

16. SOFTWARE

It may be necessary to provide You with software ("Software") provided by third parties ("Third Parties") to enable You to use the products offered via the William Hill Websites.

In such circumstances You may be required to enter into a Software Agreement with such Third Party (a "Third Party Software Agreement") in order to make use of such Software. In case of any inconsistency between these Terms of Use and any Third Party Software Agreement, these Terms of Use will prevail. We currently use Software provided by WagerLogic Limited, Boss Media AB, Virtue Fusion Limited and GameAccount Global Ltd.

You shall not interfere with, modify or reverse engineer any software provided to You by us and/or any Third Party or attempt to do so.

17. ACCOUNT CLOSURE

You have the right to close Your Account at any time provided Your Account does not show a balance is due to us. You should indicate Your desire to close Your Account in writing via email, fax, letter or by phone.

We reserve the right to suspend Your Account and any funds contained therein where You breach any provision of these Terms of Use.

Accounts which have remained inactive for a continuous period in excess of six (6) months may be terminated or suspended by us. In the event of such account terminaton this Agreement will be terminated automatically.

When You request closure of Your Account we will return your outstanding balance to you except in circumstances detailed in paragraph 21.

18. IT FAILURE

Where unexpected system flaws, faults or errors occur in the software or hardware which we use to provide the William Hill Websites we will take immediate steps to remedy the problem. Where such flaws, faults or errors cause a game to be interrupted in circumstances where it cannot be restarted from exactly the same position without any detriment to You or other players we will take all reasonable steps to treat You in a fair manner.

We do not accept any liability whatsoever for IT failures which are caused by the equipment which You or other players are using to access the William Hill Websites or faults which relate to Your or their internet service provider.

19. ERRORS OR OMISSIONS

If an error is made by us or our employees and agents in the amount of winnings/returns that are paid to You in Your favour, such monies should be held by You on trust for us and should be immediately repaid to us when a demand for payment is made to You. If you have monies in Your Account we may reclaim these monies from Your Account without further recourse to you.

Should We misstate any odds or terms of a bet or gaming wager to You as a result of obvious error in inputting the information via the William Hill Websites or as a result of a computer malfunction the bet or game will be deemed to have taken place on the correct terms or prices which were available through William Hill (absent the publishing error) at the time that the bet was struck and the game will be deemed to have taken place on the terms which were usual for that game.

Neither we nor our employees or agents shall be liable for any loss including loss of winnings that results from any error by us or You. You will forfeit any winnings/losses that result from any such error.

20. EXCLUSION OF OUR LIABILITY

Your access to the William Hill Websites and use of the products offered via the William Hill Websites is at Your sole option, discretion and risk. We shall not be liable for any attempts by You to use the William Hill Websites by methods, means or ways not intended by us.

We will provide the William Hill Websites with reasonable skill and care and substantially as described in the Terms of Use. We do not make any other promises or warranties regarding the William Hill Websites or the products offered via the William Hill Websites.

Save as provided in our Betting Rules our maximum liability to You or any third party arising out of these Terms of Use or Your use of the William Hill Websites, whether for breach of contract, tort (including negligence), or otherwise will be limited in any six (6) month period to the greater of i) the amount if any, You have paid from Your Account via the William Hill Websites in the same six (6) month period and in relation to the product offered via the William Hill Websites relevant to which the liability in question has arisen; and ii) ten thousand pounds sterling (£10,000).

We (including our parent, subsidiaries, affiliates, officers, directors, agents and employees) shall not be liable to You in contract, tort (including negligence) or otherwise for any business losses, including but not limited to loss of data, profits, revenue, business, opportunity, goodwill, reputation or business interruption or for any losses which are not currently foreseeable by us arising out of these Terms of Use or Your use of the William Hill Websites.

Nothing in these Terms of Use will operate so as to exclude any liability which we may have in respect of fraud, or death or personal injury caused by our negligence.

21. BREACH OF THE TERMS OF USE

You shall compensate us in full for any claims, liabilities, costs, expenses (including legal fees) and any other charges that may arise as a result of Your breach of the Terms of Use or any breach by You or by any other person using Your Account (whether or not authorised by You) of any laws of any jurisdiction which is applicable to You, or any William Hill Website.

Where You are in material breach of the Terms of Use, we reserve the right, but shall not be required, to; i) provide a warning to You for failure to comply; and/or ii) ban You from the William Hill Websites and terminate these Terms of Use, whether or not any prior warning has been given.

We have the right to disable any user identification code or password, whether chosen by You or allocated by us, at any time, if in our reasonable opinion You have failed to comply with any of the provisions of the Terms of Use.

In addition to any other remedy available, if You materially breach any of these Terms of Use Your winnings will be forfeited. In these circumstances William Hill may retain any positive balance then existing on Your Account pending investigation and/or the conclusion or any legal proceedings.

22. INTELLECTUAL PROPERTY RIGHTS

All website design, text, graphics, music, sound, photographs, video, the selection and arrangement thereof, software compilations, underlying source code, software and all other material contained within the William Hill Websites are subject to copyright and other proprietary rights which are either owned by us or used under licence from third party rights owners. To the extent that any material contained on the William Hill Websites may be downloaded or printed then such material may be downloaded to a single personal computer only and hard copy portions may be printed solely for Your own personal and non-commercial use.

Under no circumstances shall the use of the William Hill Websites grant to any user any interest in any intellectual property rights (for example copyright, know-how or trade marks) owned by us or by any third party whatsoever.

No rights whatsoever are granted to use or reproduce any trade marks or logos which appear on the William Hill Websites except as specifically permitted in accordance with the Terms of Use.

You must not, nor must You allow any other person to copy, store, publish, rent, licence, sell, distribute, alter, add to, delete, remove or tamper with the William Hill Websites or any part of them in any way or directly or indirectly disrupt or interfere (or attempt to disrupt or interfere) with or alter the William Hill Websites, other than in the course of viewing or using the William Hill Websites in accordance with the Terms of Use .

All intellectual property rights in the name "William Hill" and "Will Hill", the logos, designs, trade marks and other distinctive brand features of William Hill and any content provided by William Hill for inclusion on the William Hill Websites vest in William Hill. You agree not to display or use such logos, designs, trade marks and other distinctive brand features in any manner without our prior written consent.

23. VIRUSES, HACKING AND OTHER OFFENCES

You must not misuse the William Hill Websites by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the William Hill Websites , the servers on which the William Hill Websites are stored or any server, computer or database connected to the William Hill Websites. You must not attack the William Hill Websites via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, You would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing Your identity to them. In the event of such a breach, Your right to use the William Hill Websites will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect Your computer equipment, computer programs, data or other proprietary material due to Your use of the William Hill Websites or to Your downloading of any material posted on such websites, or on any website linked to the William Hill Websites.

24. YOUR PERSONAL DATA

All information on Your Account held by us is securely data warehoused and remains confidential except where otherwise stated in the Terms of Use (including, for the avoidance of doubt, the Privacy Policy).

We are required by law (in particular by the Data Protection Act 1998 in the UK and where relevant, the Data Protection Act 2004 in Gibraltar) to comply with data protection requirements in the way in which we use any personal information collected from You in Your use of the William Hill Websites and/or the products offered via the William Hill Websites. We therefore take very seriously our obligations in relation to the way in which we use Your personal information.

When You use the William Hill Websites it will be necessary for us to collect certain information about You. This will include contact information, for example a name, postal address and email address, and may also include information about Your marketing preferences. By providing us with Your personal data You consent to our processing Your personal data, including Your sensitive personal data, for the purposes set out in the Terms of Use (including the Privacy Policy).

We will retain copies of any communications that You send to us (including copies of any emails) in order to maintain accurate records of the information that we have received. We may need to share Your information with our service providers and agents for these purposes, for example to our postal service provider. We may disclose personal data in order to comply with a legal or regulatory obligation.

25. COOKIES

The William Hill Websites use cookies to track Your use of the web and to assist the functionality of the William Hill Websites. A cookie is a small file of text which is downloaded onto Your computer when You access the William Hill Websites and it allows us to recognise when You come back to our websites. We use cookies for the purpose of allowing us to understand who is accessing the William Hill Websites and helping us to gain a picture of use of the William Hill Websites as well as for operation of Your Account. If You object to cookies or want to delete any cookies that are already stored on Your computer, we recommend that You follow the instructions for deleting existing cookies and disabling future cookies on Your file management software. Further information on deleting or controlling cookies is available within our Privacy Policy or at www.aboutcookies.org . Please note that by deleting our cookies or disabling future cookies You may not be able to access certain areas or features of the William Hill Websites.

26. COMPLAINTS AND NOTICES

No claims or disputes will be considered more than twelve weeks after the date of the original transaction. If You wish to make a complaint regarding the William Hill Websites or any service which we provide please submit Your complaint in writing as soon as is reasonably practicable.

We may give notice to You at either the email or postal address You provide to us when registering. Notice will be deemed received and properly served immediately twenty four (24) hours after an email is sent, or three (3) days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an email, that such email was sent to the specified email address of the addressee.

If there is a dispute arising from these Terms of Use which cannot be resolved by our customer service team , it should be referred, prior to taking any other steps, for adjudication by the Independent Betting Adjudication Service (IBAS).

In the event of any dispute, both You and William Hill agree that the records of the server shall act as the final authority in determining the outcome of any claim.

27. INTERPRETATION

The original text of the Terms of Use are in English and any interpretation of them will be based on the original English text. If the Terms of Use or any documents or notices related to them are translated into any other language, the original English version will prevail.

In the event that there is any conflict or inconsistency between these terms of use on the one hand and any of the Privacy Policy, Betting Rules, Casino Rules, Poker Rules, Skill Games Rules and Bingo Rules Game Rules on the other hand, these terms of use will prevail.

28. TRANSFER OF RIGHTS AND OBLIGATIONS

We reserve the right to transfer, assign, sublicense or pledge these Terms of Use, in whole or in part, to any person (but without Your consent) without notice, provided that any such assignment will be on the same terms or terms that are no less advantageous to You. You may not assign, sublicense or otherwise transfer in any manner whatsoever any of Your rights or obligations under these Terms of Use.

29. EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).

Our performance is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations may be performed despite the Force Majeure Event.

30. WAIVER

If we fail to insist upon strict performance of any of Your obligations or if we fail to exercise any of the rights or remedies to which we are entitled, this shall not constitute a waiver of such rights or remedies and shall not relieve You from compliance with such obligations.

A waiver by us of any default shall not constitute a waiver of any subsequent default.

No waiver by us of any of the provisions of the Terms of Use shall be effective unless it is expressly stated to be a waiver and is communicated to You in writing in accordance with paragraph 26 above.

31. SEVERABILITY

If any of the Terms of Use are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

In such cases, the part deemed invalid or unenforceable shall be amended in a manner consistent with the applicable law to reflect, as closely as possible, William Hill's original intent.

32. ENTIRE AGREEMENT

The Terms of Use and any document expressly referred to in them represent the entire agreement between You and us and supersede any prior agreement, understanding or arrangement between You and us, whether oral or in writing.

We each acknowledge that neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us except as expressly stated in the Terms of Use.

Neither party shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of the contract (unless such untrue statement was made fraudulently) and the other party’s only remedy shall be for breach of contract as provided in these Terms of Use.

33. LAW AND JURISDICTION

If you are betting or Gaming with William Hill Credit Limited these Terms of Use shall be governed by and interpreted in accordance with the laws of England and Wales.

If you are gaming with William Hill (Malta) Limited the Terms of Use shall be governed by and interpreted in accordance with the laws of Malta.

If you are gaming with William Hill (Gibraltar) Limited the Terms of Use shall be governed by and interpreted in accordance with the laws of Gibraltar.

The courts of England and Wales shall have non-exclusive jurisdiction over any disputes arising out of the Terms of Use.

34. RESPONSIBLE GAMING/GAMBLING

For those customers who wish to restrict their gambling, we provide a voluntary self exclusion policy, which enables You to close Your Account or restrict Your ability to place bets or game on the William Hill Websites for a minimum period of six months. You can ask that the restriction lasts for a longer period.

If You require any information relating to this facility please speak to our customer service team on 0800 085 6296. If we believe that Your gambling will cause You financial or personal difficulties then we reserve the right to close Your Account.

We will use our reasonable endeavours to ensure compliance with self exclusion. However You accept that we have no responsibility or liability whatsoever if You continue gambling and/or seek to use the William Hill Websites and we fail to recognise or determine that You have requested self exclusion in circumstances which are beyond our reasonable control. For example including but not limited to You opening a new account, gambling in an LBO or over the telephone rather than over the internet or using a different name or address.
